PREAMBUŁA
Niniejszy ,,Regulamin świadczenia i dostarczania Usług cyfrowych i Treści cyfrowych drogą elektroniczną TS TEAM LIMITED” zw. dalej: Regulaminem, określa sposób i warunki korzystania z Serwisu jak również zamawiania i korzystania z Usług cyfrowych i Treści cyfrowych dostarczanych przez Usługodawcę. W niniejszym Regulaminie wskazane są prawa i obowiązki leżące po stronie Usługodawcy wynikające ze świadczenia usług drogą elektroniczną lub dostarczania Usług cyfrowych i Treści cyfrowych, a także zakres odpowiedzialności związany ze świadczeniem lub dostarczaniem wspomnianych Usług lub Treści. Przed przystąpieniem do korzystania z Serwisu oraz Usług i Treści dostarczanych przez Usługodawcę zalecamy zapoznanie się z niniejszym Regulaminem oraz naszą Polityką Prywatności. Postanowienia niniejszego Regulaminu stanowią treść Umowy w tym Umowy o Szkolenie zawieranej pomiędzy Usługodawcą a Użytkownikiem.
§ 1
DEFINICJE
Cookies ― oznacza dane informatyczne, w szczególności niewielkie pliki tekstowe, zapisywane i przechowywane na urządzeniu końcowym Użytkownika, za pośrednictwem którego Użytkownik korzysta z Serwisu
Dane ― wszelkie treści i informacje podawane przez Użytkowników
E-book ― elektroniczna publikacja stanowiąca Treść cyfrową
Funkcjonalność ― zdolność Treści cyfrowej, Usługi cyfrowej lub towaru do pełnienia swoich funkcji z uwzględnieniem ich przeznaczenia
Integracja ― połączenie Treści cyfrowej lub Usługi cyfrowej z elementami środowiska cyfrowego konsumenta i włączenie ich do tych elementów w celu zapewnienia zgodności z umową o dostarczanie treści cyfrowej lub usługi cyfrowej
Interoperacyjność ― zdolność Treści cyfrowej, Usługi cyfrowej lub towaru do współdziałania ze sprzętem komputerowym lub oprogramowaniem innymi niż te zazwyczaj używane do korzystania z treści cyfrowej, usługi cyfrowej lub towaru tego samego rodzaju
Kodeks cywilny ― ustawa z dnia 23 kwietnia 1964 roku – Kodeks cywilny (t.j. Dz.U. z 2023 r., poz. 1610 ze zm.)
Kompatybilność ― współdziałanie Treści cyfrowej, Usługi cyfrowej, lub towaru ze sprzętem komputerowym lub oprogramowaniem, które są zazwyczaj używane do korzystania z treści cyfrowej, usługi cyfrowej, lub towaru tego samego rodzaju, bez konieczności ich przekształcania
Konsument ― osoba fizyczna dokonująca z Usługodawcą czynności prawnej niezwiązanej bezpośrednio z jej działalnością gospodarczą lub zawodową
Materiały szkoleniowe ― Treści cyfrowe stanowiące materiały szkoleniowe z zakresu działalności w social mediach, w szczególności odnoszące się do kwestii prowadzenia szkoleń online
Polityka Prywatności ― Polityka prywatności i cookies TS TEAM LIMITED
Prawa konsumenta ― ustawa z dnia 30 maja 2014 roku o prawach konsumenta (t.j. Dz.U. z 2020 r., poz. 287 ze zm.)
Prawo autorskie ― ustawa z dnia 4 lutego 1994 roku o prawie autorskim i prawach pokrewnych (t.j. Dz.U. z 2022 r., poz. 2509 ze zm.)
Profilowanie – oznacza formę zautomatyzowanego przetwarzania danych osobowych, które polega na wykorzystaniu danych osobowych do oceny niektórych czynników osobowych osoby fizycznej, w szczególności do analizy lub prognozy aspektów dotyczących osobistych preferencji i zainteresowań
Przedsiębiorca ― osoba fizyczna, osoba prawna i jednostka organizacyjna, o której mowa w art. 331 § 1 Kodeksu cywilnego, prowadząca we własnym imieniu działalność gospodarczą lub zawodową
Przedsiębiorca na prawach konsumenta ― osoba fizyczna zawierająca umowę bezpośrednio związaną z jej działalnością gospodarczą, gdy z treści tej umowy wynika, że nie ma ona dla tej osoby charakteru zawodowego, wynikającego w szczególności z przedmiotu wykonywanej przez nią działalności gospodarczej, udostępnionego na podstawie przepisów o Centralnej Ewidencji i Informacji o Działalności Gospodarczej

RODO ― rozporządzenie Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 roku w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych) (Dz.U. UE. L. z 2016 r., poz.119.1)
Serwis ― strony internetowe (w tym Sklep), których właścicielem jest Usługodawca, w tym prowadzone pod adresem: https://tsmarketinglimited.com/
Sklep Internetowy (Sklep) ― strona internetowa Usługodawcy za pośrednictwem której Użytkownik może nabyć Usługę lub Treść cyfrową
Strona internetowa ― dokument HTML (plik tekstowy odczytywany przez przeglądarkę internetową) udostępniany w Internecie przez serwer WWW
System teleinformatyczny ― zespół współpracujących ze sobą urządzeń informatycznych i oprogramowania, zapewniający przetwarzanie i przechowywanie, a także wysyłanie i odbieranie danych poprzez sieci telekomunikacyjne za pomocą właściwego dla danego rodzaju sieci urządzenia końcowego
Szkolenie ― odpłatna Usługa cyfrowa połączona z dostarczaniem Treści cyfrowych przez Usługodawcę, która odnosi się przede wszystkim do kwestii nauki i porad w zakresie prowadzenia szkoleń online
Środowisko cyfrowe ― sprzęt komputerowy, oprogramowanie i połączenia sieciowe wykorzystywane przez konsumenta w celu uzyskania dostępu do treści cyfrowej lub usługi cyfrowej lub w celu korzystania z nich
Treść cyfrowa/Treść ― dane wytwarzane i dostarczane przez Usługodawcę w postaci cyfrowej
Umowa ― umowa zawarta pomiędzy Usługodawcą a Użytkownikiem, z wykorzystaniem Serwisu, w ramach której Usługodawca zobowiązuje się do świadczenia usług drogą elektroniczną, świadczenia określonych Usług cyfrowych lub dostarczenia Treści cyfrowych
Umowa o Szkolenie ― Umowa zawierana pomiędzy Usługodawcą a Użytkownikiem, której przedmiotem jest Szkolenie
Urządzenie ― urządzenie elektroniczne, za pomocą którego Użytkownik może korzystać z usług lub treści cyfrowych dostarczanych przez Usługodawcę, w szczególności komputer osobisty, laptop, tablet, smartphone, czytnik e-booków
Urządzenie końcowe ― urządzenie telekomunikacyjne przeznaczone do podłączenia bezpośrednio lub pośrednio do zakończeń sieci
Usługi cyfrowe/Usługi ― usługi świadczone przez Usługodawcę pozwalające konsumentowi na: wytwarzanie, przetwarzanie, przechowywanie lub dostęp do danych w postaci cyfrowej, wspólne korzystanie z danych w postaci cyfrowej, które zostały przesłane lub wytworzone przez konsumenta lub innych użytkowników tej usługi, inne formy interakcji za pomocą danych w postaci cyfrowej
Usługi elektroniczne ― wszelkie usługi świadczone drogą elektroniczną przez Usługodawcę na rzecz Użytkowników w oparciu o niniejszy Regulamin

PREAMBLE
This “Terms and Conditions for the Provision and Delivery of Digital Services and Digital Content Electronically by “TS TEAM LIMITED” hereinafter referred to as the “Terms,” specifies the manner and conditions for using the Service, as well as ordering and using digital services and digital content provided by the Service Provider. This document outlines the rights and obligations of the Service Provider related to the provision of electronic services or the delivery of digital services and digital content. It also delineates the extent of responsibility associated with the provision or delivery of such services or content. Before using the Service and the services and content provided by the Service Provider, we recommend familiarizing yourself with these Terms and our Privacy Policy. The provisions of these Terms constitute the content of the Agreement, including the Mentoring Agreement, entered into between the Service Provider and the User.
§ 1
DEFINITIONS
Cookies – means computer data, in particular small text files, recorded and stored on the User’s terminal device, through which the User uses the Site
Data – all content and information provided by Users
E-book – an electronic publication that constitutes Digital Content
Functionality – the ability of the Digital Content, Digital Service or goods to perform their functions, taking into account their purpose
Integration – the combination of Digital Content or Digital Service with elements of the consumer’s digital environment and its integration into these elements to ensure compliance with the contract for the provision of Digital Content or Digital Service
Interoperability – the ability of Digital Content, Digital Service or goods to interoperate with computer hardware or software other than those normally used to use Digital Content, Digital Service or goods of the same type
Civil Code – the Act of April 23, 1964 – Civil Code (i.e. Journal of Laws of 2023, item 1610, as amended).
Compatibility – the interaction of Digital Content, Digital Service, or goods with computer hardware or software that is normally used to use Digital Content, Digital Service, or goods of the same kind, without the need to transform them
Consumer – a natural person performing a legal transaction with the Service Provider that is not directly related to his/her business or professional activity
Training Materials – Digital Content constituting training materials in the field of social media activities, in particular relating to sales issues and contact with customers
Mentoring – a paid Digital Service combined with the provision of Digital Content by the Service Provider.
Content Moderation – means actions, whether or not automated, taken by the Service Provider that are aimed, in particular, at detecting, identifying and combating illegal content or information that does not comply with the Terms of Service, provided by Users, including measures implemented that affect the availability, visibility and reachability of such illegal content or information, such as deposition of such content or information, demonetization, preventing access to or deletion of such content or information, or that affect the ability of Users to provide such information, such as closing or suspending an account
Illegal content – means information that, in itself or by reference to an action, including the sale of products or the provision of services, does not comply with the law of the Union or with the law of any Member State that complies with the law of the Union, regardless of the specific subject matter or nature of that law
Privacy Policy – TS TEAM LIMITED privacy and cookies policy.
Consumer Rights – the Law of May 30, 2014 on Consumer Rights (i.e. Journal of Laws of 2020, item 287 as amended).
Copyright – the Act of February 4, 1994 on Copyright and Related Rights (i.e. Journal of Laws of 2022, item 2509 as amended).
Profiling – means a form of automated processing of personal data that involves the use of personal data to evaluate certain personal factors of an individual, in particular to analyze or forecast aspects of personal preferences and interests
Entrepreneur – a natural person, a legal person and an organizational unit referred to in Article 331 § 1 of the Civil Code, conducting a business or professional activity on its own behalf
Entrepreneur on the rights of a consumer – a natural person entering into a contract directly related to his/her business activity, when it follows from the content of the contract that it is not of a professional nature for that person, arising in particular from the subject of his/her business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity
Point of Contact – a point of contact maintained at: tatiana13rzesy@gmail.com, which can be used for direct communication with Member State authorities, the Commission, the Digital Services Board, as well as with Users using the Site
Terms and Conditions – the Terms and Conditions for the provision and delivery of Digital Services and Digital Content electronically by WB Global Ltd.
RODO – Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU. L. 2016, item 119.1)
Website – the websites (including the Store) owned by the Service Provider, in particular maintained at: https://tsmarketinglimited.com, as well as, to the appropriate extent, the Service Provider’s fanpages maintained on social networks
Online Store (Store) – the Service Provider’s website through which the User may purchase a service or digital content
Website – an HTML document (a text file readable by a web browser) made available on the Internet by a web server
ICT system – a set of cooperating IT devices and software, providing processing and storage, as well as sending and receiving data via telecommunication networks by means of a terminal device appropriate for a given type of network
Digital environment – computer hardware, software and network connections used by a consumer to access or use digital content or digital service
Digital Content/Content – data produced and provided by the Service Provider in digital form
Agreement – an agreement concluded between the Service Provider and the User, using the Website, under which the Service Provider undertakes to provide electronic services, to provide certain Digital Services or to provide Digital Content
Mentoring Agreement – an agreement concluded between the Service Provider and the User, the subject of which is Mentoring
Device – an electronic device through which the User may use the services or Digital Content provided by the Service Provider, in particular a personal computer, laptop, tablet, smartphone, e-book reader
Terminal Device – a telecommunications device designed to connect directly or indirectly to network terminations
Digital Services/Services – services provided by the Service Provider that allow the consumer to: generation, processing, storage or access to digital data, sharing of digital data that has been transmitted or created by the consumer or other users of this service, other forms of interaction through digital data
Electronic Services – all services provided electronically by the Service Provider to Users based on these Terms and Conditions

Consumer Rights Act – the Act of May 30, 2014 on consumer rights (i.e. Journal of Laws 2023, item 2759 as amended).
User – a natural person, legal person and organizational unit referred to in Article 331 § 1 of the Civil Code.
Order – a declaration of will of the User, unambiguously specifying the type and quantity of Digital Services or Digital Content he/she intends to purchase as well as the process, aimed directly at concluding the Agreement
Resources of the Website – means all materials made available within the Website
§ 2
GENERAL TERMS OF USING THE SITE
Before using the Site, the User should read these Terms and Conditions and the Privacy Policy.
Before providing his/her personal data, the User acknowledges that it may be processed by the Service Provider under the terms of the Privacy Policy. In addition, the User, by expressing his/her willingness to start using the Site, declares that:
is of legal age,
he/she is entitled to conclude a contract for the provision of services by electronic means,
the data provided by him does not violate any rights of third parties and is consistent with the facts,
he/she has familiarized himself/herself with the Regulations and undertakes to abide by them, and has read the Privacy Policy.
The Service Provider provides the following Electronic Services:
enabling the use of the Website Resources,
enabling the use of dedicated forms,
enabling the purchase of specific Digital Services or Digital Content,
enabling the download of specific content (e-books, among others),
enabling participation in live online meetings,
enabling you to send messages through the Service,
enabling commenting or expressing reactions,
enabling the delivery of certain content by Users,
receiving commercial and marketing information.
In order to ensure the correctness of the provision of services by electronic means, the User is obliged to provide truthful data and information about himself and to keep them updated.
In particular, the User is obliged to:
refrain from any actions that may hinder or interfere with the functioning of the Service,
refrain from any actions that are against the law and violate the privacy of others, in particular, not to provide content of an unlawful nature.
The User has the right to use the Service at any time.
The user wishing to use the Website should meet the following technical requirements:
have a device that allows access to the Internet, equipped with a working operating system,
install on the device referred to in point 1 above the latest, up-to-date version of a web browser providing access to the resources of the Internet (e.g. Internet Explorer, Opera, Mozilla FireFox, Safari, Google Chrome or other compatible browser, supporting cookies).
The Service Provider reserves the right to:
temporarily cease operation of the Website due to maintenance activities or related to modification of the portal, as well as modification of services, tools and the way the Website operates,
to cease operations or transfer rights to other entities, and to undertake other legally permitted activities related to the Site, with the proviso that in the case of processing of Users’ data, the Service Provider will inform the Users of such plans and ask for their consent to transfer the Users’ data to other entities, indicating which entities are involved,
Withdraw the Users’ access to the Resources in case of erotic or pornographic content, illegal software or information on its acquisition, and other content contrary to the law or morality.
It is forbidden to copy, distribute or disclose any part of the Website in any way, including, but not limited to, by automatic or non-automatic „scraping”.
You may not sell, transfer or assign your right to use the Service, to a third party.
The User agrees that the Service Provider may record the telephone conversation conducted with him/her.
§ 3
SHOP
The Service Provider provides both paid and unpaid Digital Services as well as both paid and unpaid Digital Content.
The Online Store sells paid Digital Services and Digital Content.
An order can be placed from anywhere.
Information about Digital Services and Digital Content presented on the Website does not constitute an offer within the meaning of the Civil Code.
Placing an Order constitutes an offer, within the meaning of the Civil Code, made by the User to the Service Provider.
The Store may be used only by Users who are natural persons of full legal age and have full legal capacity, as defined by the Civil Code, and who are legal persons and organizational units without legal personality.
The use of the Online Store is possible on condition that the User meets the following technical requirements:
having a device that allows access to the Internet, equipped with a working operating system,
installing on the device referred to in point 1 above the latest, up-to-date version of a web browser providing access to Internet resources, such as Internet Explorer, Opera, Mozilla FireFox, Safari, Google Chrome or other compatible browser, which supports cookies,
having an active e-mail account.
The Service Provider shall not be liable for disruptions, including interruptions, in the operation of the Online Store caused by force majeure, unauthorized actions of third parties or incompatibility of the Online Store with the User’s technical infrastructure.
The Service Provider is not responsible for the blocking by mail server administrators of the transmission of messages to the e-mail address indicated by the User, and for the deletion and blocking of e-mails by software installed on the equipment used by the User, as well as for the inability to use the services offered by the Service Provider due to failures, technical interruptions, power outages, etc.
As a condition for the purchase of Services or Digital Content by the User, the User is required to be familiar with these Regulations as well as the Privacy Policy, and to accept their provisions.
Ignorance of the Regulations does not exempt the User from compliance with the rules contained therein.
The User is obliged not to provide content that is prohibited by law, such as content that promotes violence, that is defamatory or that violates personal rights and other rights of third parties.
By placing an Order, the User may request that the Order be fully completed before the expiration of the deadline for withdrawal from the Agreement, and accepts that in such case he/she loses the right to withdraw from the Agreement. The User confirms the above by checking the appropriate box (checkbox).
The Order is placed by selecting the „Buy and pay” button or other equivalent.
After submitting the Order, the User is redirected to the subpage of the payment operator, where he/she makes the payment.
The contract is concluded upon confirmation of acceptance of the Order by the Service Provider.
§ 4
MENTORING
Mentoring constitutes a paid Digital Service combined with the provision of Digital Content by the Service Provider.
As part of Mentoring, the Service Provider undertakes to provide the User with training on customer acquisition using certain online tools including social media and general social media activity, and undertakes to provide the User with certain Training Materials.
Mentoring includes in its scope the provision of certain tools, knowledge, development of skills and guarantee of mental support.
The User acknowledges that the Mentoring Agreement constitutes a contract of diligence, and consequently the Service Provider shall not be liable (including for results) for any defective or incomplete use of knowledge or experience gained during Mentoring. The effects of Mentoring depend, among other things, on the User’s commitment and individual predisposition.
The Mentoring Agreement is concluded for a fixed period of either 3 or 6 months (depending on the package purchased).
As a rule, the Mentoring Agreement is not subject to early termination. However, the User may terminate the Mentoring Agreement with immediate effect only for valid reasons, by which is meant a flagrant failure of the Service Provider to comply with its provisions. The Parties shall not consider the loss of confidence in the other Party as a valid reason. Termination of the Mentoring Agreement in this manner requires written form under pain of nullity. The Parties shall not be entitled to terminate the Mentoring Agreement without a valid reason.
Mentoring may be conducted in whole or in part by the Service Provider or a third party to which the User agrees.
As part of Mentoring, the User receives:
access for a period of 3 or 6 months (depending on the package purchased) to an online modular training course via a dedicated web platform,
access for a period of 3 or 6 months (depending on the package purchased) to certain Training Materials through a dedicated online platform with the possibility to download certain Training Materials,
access for a period of 3 or 6 months (depending on the purchased package) to closed, non-public channels on the Slack messenger associating Users who use Mentoring,
possibility for a period of 3 or 6 months (depending on the purchased package) to use consultations via Zoom.
Users wishing to use Mentoring should meet the following technical requirements:
have a device that allows access to the Internet, equipped with a working operating system,
install on the device referred to in point 1 above the latest, up-to-date version of an Internet browser providing access to Internet resources (e.g. Internet Explorer, Opera, Mozilla FireFox, Safari, Google Chrome or other compatible browser that supports cookies).
Digital Services and Digital Content (including Training Materials) provided as part of Mentoring are characterized by functionality in the form of playback/opening via electronic devices with programs for opening files in formats in which these Services or Content are provided (e.g., reading pdf. files, playing videos).
Consultations referred to in paragraph 8.4 of this section shall be held once a week. The exact date and time of the consultation is announced the day before on the channel on the Slack communicator referred to in paragraph 8, item 3 of this paragraph. A link enabling participation in the consultations is published on the channel on the Slack messenger.
The consultations are of a group nature, with the person conducting the conversation at a given time talking only to one User, while the other Users may listen to it, to which each User agrees.
The User participating in the consultation agrees to the recording of each online meeting (consultation), including the recording of his image and voice.
The Service Provider will allow Users to access the recording of consultations through a dedicated online platform, to which Users agree.
The Service Provider shall allow access to the recording of consultations in which a given User participated, also to other both current and future Users (Mentoring participants), to which each User agrees.
The Service Provider has the right to use recordings or photos of online consultations (including the User’s image and voice) for purposes related to its business, to which the User agrees.
Failure to use all or part of the Digital Services or Digital Content under Mentoring for reasons attributable to the User shall not entitle the User to demand a refund of the price paid or part thereof or failure to pay the price in full.
The User agrees that the Service Provider may use and make public the results of the User’s work (so-called „transformation”) achieved under Mentoring.
The Service Provider is under no obligation to respond to private messages sent via Slack messenger or via Instagram/Facebook. To contact the Service Provider, please send an email to: info@wealthybrand.io.
The Service Provider agrees that the User may refer to the services performed on its behalf for informational or reference purposes by referring to the name, logo and general description of the training.
Service Provider guarantees Mentoring to the User under the following conditions.
The Service Provider guarantees the User a refund of the full amount of remuneration actually received if, within 60 days counting from the date of the onboarding conversation with the User, there is not at least a doubling of: the average number of leads achieved so far by the User and declared by the User during the aforementioned conversation.
By „lead” the Parties understand the expression of interest in any form by a third party in the User’s activity (including the service or product offered by the User), and in particular the addition by a third party of any comment or reaction under the User’s entry/post/roll – the subject of which is, among others.including but not limited to the service or product offered by the User, or a „lead magnet” or „freebie” as defined by the nomenclature used during Mentoring (during training, in consultations or on Slack), as well as a private message addressed by a third party to the User, the subject of which is, among other things, the service or product offered by the User.
The warranty is subject to the combined fulfillment of the following conditions:
User’s performance of all tasks ordered within the framework of Mentoring by any coach (including reporting),
each time the User informs the Service Provider using Slack messenger about his/her problems or challenges with Mentoring within 48 hours of the problem or challenge,
active participation by the User on all online consultations, i.e. participation linked to speaking,
publication by the User collectively on all online platforms i.e. Facebook, Instagram, TikTok and YouTube of at least one post/roll each day.
In order to take advantage of the guarantee, the User is obliged to inform the Service Provider by email within 14 days counting from the expiration of 60 days from the day of the onboarding conversation with the User about the lack of doubling of leads. After the expiration of the said period, the User loses his/her rights under the warranty.
The warranty is valid throughout the Earth.
The warranty does not exclude, limit or suspend the User’s rights to exercise other legal remedies provided by generally applicable law.
The Service Provider also provides, in addition to Mentoring, other paid digital Content or Digital Services, the offer of which is presented within the Service, and to which the relevant provisions of these Regulations apply.
§ 5
PRICES AND PAYMENT
The prices of Digital Services or Digital Content posted within the Site (including at the stage of placing an Order) are gross prices and are expressed in Polish zlotys.
Information about the total value of the Order, which includes the price of the Digital Service or Digital Content, is provided each time on the Store’s website during the placement of the Order, including before the User directly approves and submits the Order. These are the total costs that the User is obliged to pay, including applicable taxes and other costs.
The Service Provider reserves the right to change the prices of Digital Services or Digital Content presented on the Website, to withdraw and introduce new Digital Services or Digital Content, to carry out and cancel any kind of promotional actions and sales. The above entitlement shall not affect Orders which were placed before the effective date of any of the changes mentioned above.
When placing an Order, the User selects the currently offered by the Service Provider, available payment method.
The Service Provider may offer payment in installments in justified cases. In this case, the User is obliged to pay the entire sales price, however, within the specified installment payment periods.
The User acknowledges that some payment operators may offer installment payment, which involves payment of the entire sales price, however, on specified installment payment dates.
If the sales price is not paid in full, the Service Provider will be able to seek payment from the User through the courts.
For each order, the Service Provider will issue to the User a corresponding billing document confirming the transaction. At the request of the User, the Service Provider will issue an invoice without VAT. The User authorizes the Service Provider to issue the billing document without signature. The Service Provider shall send the billing document to the User electronically, to the indicated e-mail address in the form of an electronic image of the billing documents.
§ 6
SOCIAL NETWORKS
The Service Provider may use services and technologies offered by:
Meta Platforms Inc. such as: Facebook, Messenger and Instagram;
Bejing ByteDance Technology Co Ltd. such as: TikTok;
Alphabet Inc. such as: YouTube.
In order to obtain full accessibility in terms of the services and technologies offered by the aforementioned entities, Users should have an account on Facebook and Instagram, TikTok and Google, respectively.
The Service Provider points out that the use of services and technologies offered by the aforementioned entities may require reading and accepting separate rules and regulations provided by these entities.
The processing of Users’ personal data within the framework of services and technologies offered by the aforementioned entities is carried out in accordance with the Privacy Policy.
The Service Provider is not responsible for the lack of access or lack of full functionality in the use by Users of the services and technologies offered by the above-mentioned entities for reasons beyond its control.
The Service Provider’s Website may contain references (hyperlinks) to other websites operated by the Service Provider’s business partners. Use of these sites may require acceptance of additional regulations or privacy policies.
§ 7
MARKETING, COMMERCIAL INFORMATION AND PROMOTION AND ADVERTISING
As part of the Site, the Service Provider may offer the completion of a survey and the opportunity for Users to provide certain consents in exchange for which they may receive certain Digital Content in the form of an e-book.
As part of the survey, the User is required to provide truthful information regarding: name, phone number, email address, profile name on Instagram, products or services currently offered, amount of monthly revenue, price of products or services offered, and the purpose of the User’s business.
In order to receive the e-book referred to above, the User must provide the information referred to in the paragraph above and provide the mandatory consents by checking the appropriate check-boxes.
After completing the questionnaire and providing the consents, the User will be automatically transferred to the website from where he/she will be able to download the e-book.
Processing and use of the personal data provided in the form and the profile photo on Instagram, by the Service Provider for the purpose of promoting and advertising the Service Provider’s business, including products and services, may mean, in particular, the use of the User’s profile name on Instagram and his/her profile photo on Instagram in training courses, webinars, live events and promotional or advertising materials conducted by the Service Provider, without additional compensation.
The User may grant the consents referred to in paragraph 3 of this section in particular also at the stage of placing the Order.
§ 8
SERVICE PROVIDER AS AN ENTITY ESTABLISHED IN A THIRD COUNTRY
The User acknowledges that the Service Provider is based in the People’s Republic of China, which is a third country under the RODO.
The People’s Republic of China has not been issued a decision by the European Commission finding an adequate level of protection (Article 45(3) of the RODO).
The User acknowledges that the Service Provider may not provide all the appropriate safeguards referred to in Article 46(2) of the RODO, as well as may not provide all applicable enforceable data subject rights and effective remedies (Article 46 of the RODO), including binding corporate rules (Article 47 of the RODO).
The transfer of your personal data to a third country for which no decision has been issued declaring an adequate level of protection (Art. 45(3) RODO) and due to the lack of adequate safeguards (Art. 46 RODO) including binding corporate rules (Art. 47 RODO), may involve a possible risk of violation of the rights or freedoms of persons, of varying probability and severity of risks, which may lead to physical harm or damage to property or non-property, in particular: the processing may result in discrimination, identity theft or identity fraud, financial loss, damage to reputation, breach of confidentiality of personal data protected by professional secrecy, unauthorized reversal of pseudonymization, or any other significant economic or social harm; data subjects may be deprived of their rights and freedoms or the ability to exercise control over their personal data; if personal factors are assessed, in particular analyzed or projected aspects of work performance, economic situation, health, personal preferences or interests, reliability or behavior, location or movement – there is a risk of personal data being used to create or exploit personal profiles.
§ 9
COMPLAINT
The Service Provider shall be liable, as provided by law, for the compliance of performance with the Contract.
Users have the right to file a complaint in connection with the concluded Agreement (including the functioning of the Service), by submitting a request to the e-mail address: tatiana13rzesy@gmail.com.
A properly filed complaint should contain at least the following data:
designation of the User (name and surname, email address),
designation of the Agreement or the Service, the operation of which the complaint concerns, or designation of the case,
justification of the complaint,
indication of what the User is demanding.
The Service Provider will make every effort to consider complaints within 14 days of receipt at the latest.
The Service Provider will notify the User about the consideration of the complaint by sending a message to the e-mail address provided in the complaint.
Entrepreneur and Entrepreneur on consumer rights are not entitled to file a complaint.
§ 10
OUT-OF-COURT WAYS OF DEALING WITH COMPLAINTS AND CLAIMS
A dispute arising between a Consumer and the Service Provider may be resolved amicably through out-of-court consumer dispute resolution proceedings.
The Service Provider’s participation in the proceedings for out-of-court settlement of consumer disputes is voluntary, and the information provided below does not constitute an obligation on the Service Provider to participate in such proceedings. If the dispute is not resolved following a complaint filed by the Consumer, the Service Provider shall each time provide the Consumer with a statement in writing or in another durable medium of its intention to request the initiation of proceedings for out-of-court resolution of consumer disputes or its consent to participate in such proceedings or its refusal to participate in proceedings for out-of-court resolution of consumer disputes. Failure to act on the part of the Service Provider shall be considered a lack of consent to participate in the amicable proceedings.
Under the rules set forth in the Act of December 15, 2000 on Trade Inspection (i.e. Journal of Laws of 2020, item 1706, as amended), a dispute over property rights arising from the use of the Site may be submitted to the settlement of permanent arbitration courts at the provincial inspectors of the Trade Inspection at the request of the Consumer.
Under the rules set forth in the Act referred to in the above paragraph, if the nature of the case warrants it, the Provincial Inspector of Commercial Inspection shall undertake actions aimed at an out-of-court settlement of a civil law dispute between the Consumer and the Service Provider by enabling the parties to bring the positions of the parties closer together in order to resolve the dispute by the parties thereto, or to present the parties with a proposal for resolving the dispute. Proceedings shall be initiated̨ at the request of the Consumer, submitted to the Provincial Inspector having jurisdiction over the place of business of the Service Provider.
The Consumer may also turn̨ to the district (city) consumer ombudsman, whose tasks include, in particular, the provision of free consumer advice and legal information on the protection of consumer interests, as well as acting to entrepreneurs in matters of protection of consumer rights and interests.
The rules and procedures for access to out-of-court resolution of consumer disputes are defined separately in the law (including, in particular, the Act of September 23, 2016 on out-of-court resolution of consumer disputes, Journal of Laws, item 1823, as amended) or in the regulations applied by entities authorized in the resolution of consumer disputes, in particular, in the rules and regulations in force at these entities. Consumers may also obtain information about out-of-court procedures for handling complaints and pursuing claims, as well as rules of access to these procedures, on the websites of district (city) consumer ombudsmen, social organizations, provincial commercial inspection inspectorates, social organizations whose statutory tasks include consumer protection and the Office of Competition and Consumer Protection (in particular: https://www.uokik.gov.pl/pozasadowe_rozwiazywanie_sporow_konsumenckich.php).
Pursuant to Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No. 2006/2004 and Directive 2009/22/EC (Regulation on ODR in consumer disputes), a consumer may filé a complaint̨ through the ODR online platform (http://ec.europa.eu/consumers/odr/).
§ 11
CONTENT PROVIDED BY USERS
The Service Provider may provide Users with the ability to provide certain content, including the ability to add comments, express opinions or actively participate in dedicated closed or open groups/channels of communication.
The User acknowledges and agrees that all content posted by the User will be visible to others with access to the Service or groups/channels.
The User shall not provide illegal content or other content that is inconsistent with the Terms of Service or contrary to good morals.
The Service Provider has the right to moderate content provided by Users.
The Service Provider does not perform preventive control of the content provided by Users.
The Service Provider does not verify whether the content provided comes from Users who have used or are using the Service Provider’s services and products.
The Service Provider has the right to verify the content provided by Users at any time.
The User has the right to report to the Service Provider via e-mail to: tatiana13rzesy@gmail.com any content that, in the opinion of the User, is illegal, violates the Regulations or is contrary to good morals. The Service Provider will make every effort to verify the content without undue delay and respond to the reporting User by e-mail.
If the Service Provider finds that the User has provided content that is illegal, in violation of the Regulations or contrary to good morals, it may:
block or permanently remove such content,
suspend the User’s ability to use certain functionalities of the Site (including within the scope of the Mentoring Agreement) for a period from 1 day to 365 days,
permanently prevent the User from using certain functionalities of the Service (including in the scope of the Mentoring Agreement),
block the User’s account for a period from 1 day to 365 days,
permanently delete the User’s account.
The Service Provider will notify the User by e-mail without undue delay of the action taken as mentioned in the above paragraph. The decision will include a justification.
The Service Provider shall not be liable for the content provided by the Users, if the Service Provider did not have actual knowledge of illegal content, content that violates the Terms of Use or is contrary to good morals, and after coming into possession of such knowledge, took immediate action to block or permanently remove such content.
The User may appeal if the Service Provider:
has not blocked or removed the content provided by the User despite a request from another User or a third party,
blocked or removed content provided by the User that is illegal, violates the Terms of Service or is against good morals,
applied any sanctions against the User related to the content provided by the User.
An appeal may be submitted in electronic form to: tatiana13rzesy@gmail.com.
The appeal should include: name and surname (or company) of the person submitting the appeal, contact details (including e-mail address); detailed reasons why, in the appellant’s opinion, the Service Provider’s decision was wrong and should be changed.
The Service Provider will make every effort to consider the appeal within 14 days from the date of its submission.
The Service Provider will respond to the appeal electronically to the email address provided by the Appellant.

§ 12
COPYRIGHTS AND RELATED RIGHTS
The resources of the Site, all digital Content, in particular texts, scripts, graphics, interactive elements, trademarks/service marks, as well as all mp3, video and e-book recordings made available by the Service Provider for a fee or free of charge – are the property of the Service Provider or the Service Provider has the right to dispose of them in a specific manner, as well as subject to protection under generally applicable laws, including, in particular, the provisions of the Copyright Law.
The User has the right to use any materials posted on the Site or made available to him by the Service Provider (e.g. Training Materials) only for his own personal use. In particular, the User has the right to use the document templates made available to him to conclude contracts to which he is a party. Use of the materials in any other scope is permitted only on the basis of prior express written consent granted by the Service Provider.
The User has no right to transfer the Training Materials, and in particular the document templates including contracts, to third parties for a fee or free of charge.
It is forbidden to use for any purpose, in particular advertising, commercial and promotional purposes, any content contained on the Site or made available by the Service Provider under the concluded agreements, including materials in pdf format, video and mp3 recordings, files in avi, mp4, mov format or in the form of CD and DVD recordings, as well as making available or playing in public, regardless of the purpose and form of these actions without the prior, express, written consent of the Service Provider, unless the provisions of these Regulations provide otherwise.
The content presented on the Site represents the subjective opinions of their authors (including the Service Provider) and contains proposed, exemplary solutions in specific, strictly described situations. The Service Provider shall not be liable for the consequences of events resulting from the use of the content posted on the Site by the User, in a manner that is prohibited, contrary to morality or unlawful, and these consequences shall be borne solely by the User who engages in such behavior.
Considering the protection of the Service Provider’s copyright, the User undertakes not to use the content posted on the Site or otherwise made available by the Service Provider, in a manner inconsistent with applicable laws.
The User also undertakes that from the content placed on the Site or otherwise made available by the Service Provider, he will not remove information about its author, or the copyright to which he is entitled, or other information that allows the identification of the protected work.
§ 13
REPRESENTATIVE OF THE SERVICE PROVIDER IN THE EU
The Service Provider declares that, pursuant to the provision of Article 27(1) of RODO, it has appointed in writing its Representative in the European Union, which is Tetiana Shkurynska
The Representative has been authorized by the Service Provider so that, for the purposes of ensuring compliance with the RODO, he may be contacted – in addition to or instead of the Service Provider – in particular by supervisory authorities and data subjects in all matters related to processing.
§ 13
FINAL PROVISIONS
These Regulations are available free of charge on the Website in a form which makes it possible to acquire, reproduce and record their content by means of an ICT system used by the User.
In matters not regulated in the Regulations, the provisions of generally applicable Polish law shall apply, in particular the provisions of the Act of July 18, 2002 on the provision of services by electronic means (i.e. Journal of Laws of 2020, item 344 as amended), Copyright Law, Civil Code and RODO.

The Service Provider and Users agree to resolve any disputes (including those related to the Mentoring Agreement) amicably. If no agreement is reached, the Service Provider and Users who are consumers agree to submit the dispute to the settlement of a court of general jurisdiction. Any disputes arising between the Service Provider and the User who is an Entrepreneur or an Entrepreneur on the rights of a consumer shall be settled by the District Court Lublin-East in Lublin with its seat in Świdnik or the District Court in Lublin (cases of the Service Provider against the User) or the court having jurisdiction over the seat of the Service Provider (cases of the User against the Service Provider).
Appendix 1 is an integral part of the Regulations.
These Regulations shall enter into force on: March 28, 2024.
